Terms of service
These terms govern the work we do for you. The scope and price of each assignment are agreed separately in writing before anything starts.
These terms have not yet been reviewed by an advocate qualified in Kenyan law. They state our actual practice and we hold ourselves to them, but a professional review is outstanding. Tell us if anything here does not match what you were told, and we will correct it.
What we provide
VerifyKe carries out physical visits and records observations, evidence, discrepancies and limitations against a scope agreed with you in advance. We deliver a written report and an evidence index.
What a report is, and is not
A report describes what our inspector observed and which records they reviewed. It does not guarantee a safe investment, prove the absence of fraud, or certify legal ownership, boundary correctness, or structural, electrical or engineering fitness.
What we do not do
We do not sell land, broker deals, negotiate transactions, construct buildings, hold purchase funds, release escrow, or accept commission from sellers, agents or contractors.
Scope and quotation
Each assignment is scoped and quoted before work begins. Work starts only once you have accepted the scope. Scope changes are agreed and priced separately.
Specialist referrals
Where an answer requires a licensed surveyor, advocate, engineer, valuer or accountant, we will say so. Any such engagement is separate, with its own scope and fee disclosed to you.
Corrections
If we find a report to be wrong, we issue a corrected version stating what changed and why. Earlier versions are retained, not overwritten.
Cancellation and refunds
You may cancel an assignment at any time before the visit takes place. If we have not yet travelled or incurred a cost on your behalf, you owe nothing. If travel or a third-party cost has already been committed, we charge only that documented amount and refund the rest. A visit that did not happen is never charged for. If we cancel, or cannot complete the work, you are refunded in full.
If access is refused
Sites are sometimes unreachable — a locked gate, an absent caretaker, an impassable road. Where we travel and cannot get access, we record that as a not-verified finding with the reason, and charge only the travel actually incurred. We will agree a return visit with you rather than bill for a second one automatically.
Your responsibilities
The information you give us shapes what we check, so it needs to be accurate and lawfully yours to share. Where a check requires the permission of an owner, occupier or manager, you confirm you are entitled to authorise it. We will not enter an occupied property without proper permission, and we will decline an instruction that would require us to.
Liability
We are liable for failing to carry out the agreed checks with reasonable care and skill. We are not liable for the condition of a property, the conduct of a seller, agent or contractor, or a decision you take after reading a report. Except where Kenyan law does not permit it to be limited, our liability for any assignment is capped at the fee paid for that assignment.
Your evidence and your report
The report and the evidence gathered for your assignment are yours to use. We retain a copy so we can answer questions about it and issue corrections. We do not publish a client property, location or finding without written permission.
Governing law
These terms are governed by the laws of Kenya, and the Kenyan courts have jurisdiction over any dispute arising from them.
